These Terms & Conditions of Sale (“Terms & Conditions,” “Terms of Sale”) govern purchases of products and related services (“Products”) from Peaka Studio (“Peaka,” “we,” “us,” “our”) through our website and any order channels we make available from time to time (collectively, the “Site”). By placing an order, you agree to these Terms & Conditions in addition to our Terms of Service and Privacy Policy. If there is any conflict, these Terms & Conditions govern your purchase.
Our online store is hosted by Shopify Inc., which provides the e-commerce platform enabling us to sell Products to you.
1. Eligibility and Account
By placing an order, you represent that you are at least the age of majority in your jurisdiction and legally capable of entering into a binding contract. You agree to provide accurate, current, and complete information and to keep it updated.
2. Order Process and Acceptance
2.1 Placing an Order. Your order is an offer to purchase. After you place an order, we may send an order acknowledgment. This acknowledgment is not our acceptance.
2.2 Acceptance. We accept your order only when we (a) charge your payment method and/or (b) dispatch the Product(s) and send a shipping confirmation. We may, at our discretion, refuse or cancel any order, limit quantities per customer/household/account, and restrict orders that appear to be placed by dealers, resellers, or distributors.
2.3 Order Changes/Cancellation by You. Requests to modify or cancel an order must be received promptly and may not be possible once processing has begun. Custom/bespoke, engraved, or made-to-order items cannot be modified or canceled once production begins.
2.4 Fraud and Compliance Checks. Orders are subject to verification for fraud prevention, sanctions/export control compliance, and lawful use.
3. Pricing, Currency, and Taxes
3.1 Prices. Prices shown on the Site are subject to change without notice. We reserve the right to correct pricing or other errors at any time, including after you submit an order; if the correct price is higher than the price at checkout, we may contact you for instructions or cancel your order and notify you.
3.2 Currency. Prices may be displayed in multiple currencies for your convenience. If your card is billed in a different currency, your bank or payment provider may apply conversion rates and fees.
3.3 Taxes & Duties. Applicable sales/use taxes, VAT/GST, import duties, brokerage, and other fees may be charged at checkout or collected upon delivery depending on the destination and shipping method. You are responsible for any amounts not collected at checkout.
4. International Orders; Delivery; Risk of Loss
4.1 Global Shipping. We ship internationally to many countries. Estimated delivery dates are provided for convenience only and are not guaranteed.
4.2 Customs Clearance. International shipments may experience customs delays beyond our control. You are responsible for compliance with import laws and for any required information to facilitate clearance.
4.3 Title and Risk of Loss. Title and risk of loss transfer to you when we deliver the Products to the carrier. If a package is lost or damaged in transit, please notify us promptly so we can assist with a carrier investigation.
4.4 Delivery Attempts. If a shipment is refused, unclaimed, or returned due to incomplete or incorrect address information, you may be responsible for return shipping, redelivery, and any associated duties/taxes.
4.5 Third-Party International Checkout. We may from time to time offer checkout or logistics via an international commerce partner. If used, additional terms presented at checkout will apply.
5. Product Information; Variations
5.1 Descriptions. We strive for accuracy, but errors, omissions, and typographical mistakes may occur. We may correct any error and cancel orders if necessary, with a refund where payment has been taken.
5.2 Materials & Craft. Natural materials can vary. Minor variations in color, texture, finish, or stone characteristics are normal and not defects.
5.3 Images & Display. We make reasonable efforts to display colors and details accurately; however, device displays and lighting may affect appearance.
6. Availability; Pre-Orders; Made-to-Order
6.1 Availability. Products are subject to availability. We may limit quantities or discontinue items at any time.
6.2 Pre-Orders. Estimated ship dates for pre-orders are approximate and may change. We will notify you of material delays and offer options where appropriate.
6.3 Made-to-Order / Bespoke. Custom sizing, engraving, and bespoke creations may have longer lead times. These orders are final sale and non-cancelable once production begins.
7. Payment and Billing
7.1 Methods. We accept the payment methods shown at checkout. By submitting a payment, you represent that you are authorized to use the chosen method.
7.2 Charges. We may capture payment at acceptance or when the order ships; certain items (e.g., made-to-order) may be charged earlier.
7.3 Installments / BNPL. If you choose a third-party installment or “buy now, pay later” option, your repayment terms are with that provider, subject to their separate terms and credit assessment.
7.4 Failed/Disputed Payments. We may suspend fulfillment or cancel an order if a payment is declined or later reversed. We reserve the right to refuse to honor any order in the event of a disputed charge or suspected fraud.
8. Returns, Exchanges, and Refunds
Please see our Return Policy for eligibility, timelines, and procedures. In general, items must be returned in new, unworn condition with all original tags, packaging, certificates, and accessories. Custom/bespoke, engraved, and made-to-order items are final sale unless required by applicable law. Shipping, duties, and fees are typically non-refundable unless otherwise stated in the Return Policy.
9. Repairs, Resizing, and Care
We may offer repair services, resizing, and care advice for eligible Peaka items. Any written time/cost estimate is preliminary and may change after inspection. Examination for repair is not an appraisal or statement of value. If an item is lost or damaged while in our possession for repair, our liability, at our option, is limited to repair or replacement with an item of like kind and value; this shall be your sole and exclusive remedy.
10. Gift Cards and Store Credit
10.1 Issuance & Redemption. Peaka gift cards/store credits (if offered) are redeemable solely for eligible purchases from Peaka. They are not reloadable or refundable for cash (except where required by law), and may not be used to buy other gift cards.
10.2 Delivery & Risk. Electronic gift cards are delivered to the email provided at purchase. We are not responsible for lost, stolen, or misdirected cards/credits.
10.3 No Fees/Expiry. Unless otherwise stated or required by law, Peaka gift cards/store credits do not expire and have no inactivity fees.
10.4 Fraud. We may decline to honor any card/credit we suspect was obtained or used fraudulently.
11. Promotions and Price Adjustments
11.1 Promotions. Promotional codes/offers are limited-time, subject to stated terms, not transferable, not valid on prior purchases, and cannot be combined unless expressly stated. We may modify or withdraw any promotion at any time.
11.2 Price Adjustments. Unless we state otherwise, we do not offer price adjustments for past orders.
12. Prohibited Resale and Export
Purchases are for personal use or bona fide gifting only and not for resale, export, or other commercial purposes without our prior written consent. We may cancel suspected reseller or bulk orders.
13. Compliance; Sanctions and Export Controls
You represent that you are not subject to trade sanctions or on any denied-party list and that your order does not violate applicable sanctions, export control, or anti-boycott laws. We may refuse, cancel, or withhold orders where we believe fulfillment would be unlawful.
14. Warranties; Disclaimers
To the maximum extent permitted by applicable law and unless otherwise stated in writing at the time of sale, Products are provided “as is” and “as available,” without any express or implied warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement. Some jurisdictions do not allow limitations on implied warranties; in such cases, the foregoing may not fully apply.
Magnet Safety & Medical Disclaimer
Many Peaka designs contain high-strength magnetic components. By purchasing or using these Products, you acknowledge and agree to the following:

Individuals with pacemakers, implanted cardioverter-defibrillators (ICDs), insulin pumps, or any other medical implants should not use or wear magnetic jewelry. Magnetic fields may interfere with critical device function and pose serious health risks.

Peaka does not provide medical advice. If you have any medical implant or health condition that may be affected by magnets, consult your physician before using magnetic jewelry.

Peaka is not liable for any injury, loss, or complication arising from the use of magnetic Products, including interference with medical or electronic devices, to the fullest extent permitted by law.

Magnetic components should be kept away from children and from items sensitive to magnets, such as credit cards, hotel key cards, and certain electronic devices.
This disclaimer forms part of the basis of the bargain between you and Peaka.
15. Limitation of Liability
To the maximum extent permitted by law, Peaka and its officers, directors, employees, agents, suppliers, and licensors shall not be liable for any indirect, incidental, special, punitive, or consequential damages, including loss of profits, revenue, data, or goodwill, arising out of or related to your purchase or use of the Products, even if advised of the possibility. Where liability cannot be excluded, our total liability shall be limited to the amount you actually paid for the Product giving rise to the claim. These limits do not exclude liability for gross negligence, fraud, willful misconduct, or injury where such exclusion is prohibited by law.
16. Force Majeure
We are not responsible for any delay or failure to perform due to causes beyond our reasonable control, including acts of God, extreme weather, fire, flood, epidemic, war, embargoes, labor disputes, carrier or logistics failures, power outages, internet interruptions, or governmental actions.
17. Title, Intellectual Property, and Authenticity
Title to purchased goods passes as stated in Section 4. All Peaka designs, trademarks, trade dress, images, and content are protected by intellectual property laws. Nothing in these Terms & Conditions grants you any IP rights except for the limited right to use the purchased item for personal use. We stand behind the authenticity of Products sold directly by Peaka.
18. Governing Law and Dispute Resolution
These Terms & Conditions, and any non-contractual obligations arising out of or in connection with them, are governed by the laws of Hong Kong.
Arbitration. Any dispute, controversy, or claim arising out of or relating to these Terms & Conditions or any purchase shall be referred to and finally resolved by arbitration administered by the Hong Kong International Arbitration Centre (HKIAC) under the HKIAC Administered Arbitration Rules in force when the Notice of Arbitration is submitted. The seat of arbitration shall be Hong Kong, the language shall be English, and the tribunal shall consist of one arbitrator, unless otherwise agreed.
Nothing herein prevents either party from seeking interim or injunctive relief from a court of competent jurisdiction to protect its rights pending arbitration.
19. Severability
If any provision of these Terms & Conditions is found unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted and deemed severed; the remainder will continue in full force and effect.
20. Entire Agreement; No Waiver
These Terms & Conditions, together with the order confirmation, invoice, Return Policy, and any additional terms presented at checkout, constitute the entire agreement between you and Peaka for the sale. Our failure to enforce any right or provision is not a waiver.
21. Changes to These Terms & Conditions
We may update these Terms & Conditions from time to time. The “Date Revised and Posted” above indicates the effective date. Your purchase after an update constitutes acceptance of the revised Terms & Conditions.
